Marriage Contract

Marriage contracts have become fashionable in this twenty first century. This is where the husband and wife agree to be married only for a period of time. This can be done formally or informally. Usually this is characterized by writing of wills. The contract springs from the arbitrary will of the people involved. In this case the husband and wife. This usually shows who will own the property after the contract expires. The contract is usually formal when there is a common will between the parties. This is where there is alienation of a thing, and in this case one of the parties has a negative moment. There is also appropriation of the thing where the other party has a positive moment. Marriage is usually understood as a social institution. It generally constitutes of social, religious, communicative, and contractual dimensions. There are usually conflicting needs and natural inclinations when marriage is viewed as a contract. Philosophy of Marriage The philosophy of marriage acknowledges that this institution provides security for the people there in. This philosophy stipulates that the parties involved have to take full responsibility to children until they are old enough to be independent. This means that the fruits of procreation will always exist in a marriage. This is where individuals will provide protection and support to each other. In the marriage philosophy, there exists mutual respect between the parties. Each partner brings in love, and care to the relationship. In this case there is no overriding partner or superiority is not exercised in this case. There is equality between the parties. [1] Philosophy of Love This shows that people get married to the people they love and those that they are attracted to. The philosophy of love acknowledges that love normally diminishes with time when the parties get married. There are different types of love .This includes the Eros that is characterized by excitement and intimacy. This commonly exists between people of the different sex. Love is important to any marriage set up. There is also the agape and philia love. Religion There are various forms of religion in the world today. The marriage union may bring together people of diverse religions. Among the religions available[2] includes Christianity, Muslim, Hinduism, Buddhists etc. Due to high mobility rates individuals in marriage may be from different religions. This factor has influenced formation of marriage contracts. This is where either of the parties doesn’t want to change his or her religion or stay with someone of a different religion forever. They then agree to stay together just for a period. In case children are born in such set up then they may be allowed to choose for themselves once they are mature enough. When the children are still young it becomes hard to decide which religion they belong. Parties can cope by allowing children be of father’s religion till they are old enough to choose. Rearing of Children Most marriages are normally blessed with children. Some partners may agree not to have children at all. In contract marriages, partners provide care, support and protection to children when the contract still exists. When the contract expires, the parties agree who will take custody of children. Some partners may share the kids between themselves. Most of them let the mother take custody of the children and the father supports financially. In this case the father may be allowed to visit. This is how the parties cope. Communication Communication is an important aspect in any marriage set up. In marriage contracts, communication is normally very good when the parties are still married. In marriage the parties should be open to each other. They share joys, even fears. When the contract expires communication dwindles. Parties become reserved. Individuals cope by looking for new friends at work or in the neighborhood. Money When parties are married, they may have joint accounts. Each of them has to contribute some amount of money to wellbeing of the family. They are accountable to each other on how they spend their money. When the contract expires each individual chooses what to do with their finances and is not accountable to the other party. Parties may cope by taking up extra job to meet their needs. Intimacy When the individuals are married, intimacy is inevitable. The individuals will automatically have sex within the marriage institution. When the marriage contract expires, the parties will no longer enjoy the conjugal rights. Neither of the parties will demand from the other. Some individuals may still be intimate even after the marriage contract expiring. Other parties cope by having other sexual partners. Personal and Spouse Independence They are very little personal independence when parties are still married. When the contract expires the man and woman expect to be independent. The individuals are no longer accountable to each other. Each person minds his or her own business. Some parties who want their personal independence after the contract may relocate to other places. Social Activities When in marriage individuals enjoy social activities like partying, swimming or jogging together. The parties are free with one another. Such social activities bring joy to the marriage. Coping with such an issue can be tricky because the individuals could have gotten used to each other. Some may continue having social activities after the contract expires. Some cope by getting new friends to socialize with. Occupational Issues When parties are still married occupational issues are affected in relation to family responsibilities. For instance a wife may remain at home and take care of kids while the husband goes to work. When the marriage contract expires the wife may cope by getting a job and employing a house help. This is because the husband may never give her much support as before. Household Responsibilities In marriage set up, the husband and wife normally share the household responsibilities. This includes laundry work, cleaning, cooking and things like baby sitting. When the marriage contract expires, parties may cope by employing house helps or end up doing all the work by themselves which may be quite strenuous. This may need resigning from work. Conclusion Marriage in itself encompasses so many issues. There are religion issues, money, intimacy, communication among others. It is always better when the parties stick together throughout their lifetime for better and for worse. While marriage contracts are thriving in this century, they are not the best. This is because children are adversely affected. The individuals find it hard to cope .This is in relation to intimacy issues, rearing children and shouldering other responsibilities. Redemtive Vilonce in the Odyssey by Homer Essay

The myth of redemptive violence is one that is told throughout history. It is one in which violence is the creator. Whether it be creation of the cosmos, peace, or some other result, in this myth violence results in redemption. This myth has been imbedded in our society to such a degree that it is naturalized and accepted as the way things are without much reflection. For example, many Christians probably don’t contemplate the ways redemptive violence is at the heart of their religion. A classic example of the myth of redemptive violence is found in the elaborate poem The Odyssey. Many elements of violence and how we associate with violence are explored within the multitude of pages of this tale. In book nine Odysseus has to confront Polythemus, the Cyclops who is Poseidon’s son. Odysseus and his men where trapped within Polythemus’s cave, which had wine and other luxuries in it. But the Cyclops is intent on eating every last one of them and saving Odysseus, or â€Å"Nohbdy,† as Odysseus presented himself to the Cyclops, for last. Odysseus later blinds Polythemus with a burning stick, leaving him aggrieved and in pain. Writhing in pain, he opens the rock, letting Odysseus’s crew escape. This is just a primal form of the myth, but by injuring Polythemus Odysseys is released, illustrating the productive side of violence. In book ten Odysseus finds himself on the island of Aeolus, which is occupied by the witch Circe. She lures Odysseus’s men into her house and turns them into swine. Odysseus, who has an antidote to the witch’s drugs given to him by the god Hermes, is immune to the witch’s drugs and threatens her with the violence of his sword and she takes him to her bed where he persuaded her to change back his men. This tale within The Odyssey is one of violence such those Walter Wink wrote about in â€Å"The Myth of Redemptive Violence. † He writes, â€Å"cosmic order requires the violent suppression of the feminine and is mirrored in the social order by the subjugation of women to men and people to ruler. † Wink goes on to explain that this pattern can be found in Greek myths and in a range of other cultural expressions through history, right up to cartoons in modern day media. Central to this version f the myth is the suppression of powerful females, and their bodies are laid out to create the cosmos in some cases. The Odyssey provides a classic example: Circe, a powerful temptress, is subdued by Odysseus’s threat of violence, therefore placing Odysseus socially above her. Throughout the book Odysseus is faced with endless hardships. He is thrown through massive and relentless life threatening ordeals. He then comes home and finds that he must compete for his wife. These travails point toward paradoxes in the human condition. At times, we crave pain and it allows us to associate our inner evils and our violence, and that is exactly what The Odyssey does. As Wink stated in his analysis of a cartoon, â€Å"the ‘Tammuz’ element where the hero suffers – actually consumes all but the closing minutes, allowing ample time for indulging the violent side of the self. When the good guy finally wins, viewers are then able to reassert control over their inner tendencies, repress them, and re-establish a sense of goodness †¦Ã¢â‚¬  We get a good look at this process in The Odyssey, especially when Penelope asks, how do you move the bed? Odysseus replies, you can’t because I fashioned it out of a live olive tree, proving that he was truly Odysseus. The Odyssey is filled with redemptive violence, whether it be against Troy, Scally and Charibdys, Circe, and, most notably, the slaughtering of the suitors. The violence is not all just straight forward, there are power hierarchies, complex relationships, and other factors to account for in viewing violence in this incredible story.

Biography of Plato Essay Plato was a Greek philosopher, mathematician, rhetorician, writer, founder of Academy, and even a double Olympic champion. He was born in 427 BCE in family of wealthy and influential Athenian parents: Ariston and Perictione. Platos real name was Aristocles. For his athletic figure his wrestling coach called him Plato, which means â€Å"broad†. As Plato was from a wealthy family, he got the best teachers of that time, who taught him music, grammar and athletics. At the age of 20 years old, Plato meets Socrates, who became his teacher, mentor and closest person. Eight years with Socrates influenced Platos life path. After Socrates died, Plato travels to Egypt, Italy, Sicily and Cyrene. Then he came back and opened his famous philosophical Academy. The Academy was an institution of higher education. Such philosophers as Aristotle, Heraclitus, Crates and Xenocrates attended Platos Academy. Plato’s writings are dialogues and letters to his teacher Socrates, which talks about a variety of different topics, ranging from philosophy to ethic, from mathematics to rhetoric. In these dialogs Plato used Socrates as a fictional person. His early dialogues are typically devoted to investigation of a single issue, where results are rarely achieved. The middle age dialogs developed, expressed, and defended Platos conclusions about central philosophical issues. And his later writings often modify or abandon the structure of a dialogue, they were critical examinations of the theory of forms, discussions of the problem of knowledge and cosmological speculations. Platos most famous works are: The Apology of Socrates, The Symposium and The Republic. Plato started the very first University in Europe – The Academy in 387 BC in Athens. Though the Academic was not open for the public, it did not charge fees for education there. Therefore no formal teachers or students, but there was unspoken distinction between teachers and students. One of the most famous Platos student, who also attended Academy for more than 20 years was Aristotle. There are evidences of lectures given in the Academy, such as Platos lecture On the Good and The use of dialectic. Academy continued on for nearly 1000 years until it was closed by emperor Justinian, because it was believed not to follow the Christian religion. Plato died on the day of his birthday at 347 BC. Judicial Activism Essay Judicial activism is gaining prominence in the present days. In the form of Public Interest Litigation (PIL), citizens are getting access to justice. Judiciary has become the centre of controversy, in the recent past, on account of the sudden (Me in the level of judicial intervention. The area of judicial intervention has been steadily expanding through the device of public interest litigation. The judiciary has shed its pro-status-quo approach and taken upon itself the duty to enforce the basic rights of the poor and vulnerable sections of society, by pro ¬gressive interpretation and positive action. The Supreme Court has developed new methods of dispens ¬ing justice to the masses through the public interest litigation. Former Chief Justice PN. Bhagwat, under whose leadership public interest litigation attained a new dimension comments that the supreme court has developed several new commitments. It has carried forward participative justice. It has laid just standards of procedure. It has made justice more accessible to citizens. The term judicial activism is intended to refer to, and cover, the action of the court in excess of, and beyond the power of judicial review. From one angle it is said to be an act in excess of, or without, jurisdiction. The Constitution does not confer any authority or jurisdiction for activism as such on the Court. Judicial activism refers to the interference of the judiciary in the legislative and executive fields. It mainly occurs due to the non-activity of the other organs of the government. Judicial activism is a way through which relief is provided to the disadvantaged and aggrieved citizens. Judicial activism is pro ¬viding a base for policy making in competition with the legislature and executive. Judicial activism is the rendering of decisions, which are in tune with the temper and tempo of the times. In short, judicial activism means that instead of judicial restraint, the Supreme Court and other lower courts become activists and compel the authority to act and sometimes also direct the government regarding policies and also matters of administration. Judicial activism has arisen mainly due to the failure of the executive and legislatures to act. Sec-ondly, it has arisen also due to the fact that there is a doubt that the legislature and executive have failed to deliver the goods. Thirdly, it occurs because the entire system has been plagued by ineffec ¬tiveness and inactiveness. The violation of basic human rights has also led to judicial activism. Finally, due to the misuse and abuse of some of the provisions of the Constitution, judicial activism has gained significance. Besides the above mentioned factors, there are some other situations that lead to judicial activism. These are: (i) When the legislature fails to discharge its responsibilities. (ii) In case of a hung parliament where the government is very weak and instable. (iii) When the governments fail to protect the basic rights of the citizens or provide an honest, efficient and just system of law and administration, (iv) When the party in power misuses the courts of law for ulterior motives as was done during the Emergency period, and (v) Finally, the court may on its own try to expand its jurisdiction and confer on themselves more func ¬tions and powers. Areas of Judicial Activism During the past decade, many instances of judicial activism have gained prominence. The areas in which judiciary has become active are health, child labour, political corruption, environment, education, etc. Through various cases relating to Bandhua Mukti Morcha, Bihar Under trials, Punjab Police, Bombay Pavement Dwellers, Bihar Care Home cases, the judiciary has shown its firm commitment to participa ¬tory justice, just standards of procedures, immediate access to justice, and preventing arbitrary state action. Public Interest Litigation: An Innovative Step towards Judicial Activism Public interest litigation means a suit filed in a court of law for the protection of public interest such as pollution, terrorism, road safety etc. Judicial activism in India acquired importance due to public interest litigation. It is not defined in any statute or act. It has been interpreted by judges to consider the intent of public at large. The court has to be satisfied that the person who has re sorted to PIL has sufficient interest in the matter. In India, PIL initially was resorted to towards improving the lot of the disadvantaged sections of the society who due to poverty and ignorance were not in a position to seek justice from the courts. After the Constitution (Twenty Fifth Amendment Act, 1971), primacy was given to Directive Principles of State Policy by making them enforceable. The courts to improve administration by taking up PIL cases, for ensuring compliance constitutional provisions has also increased. PIL is filed for a variety of cases such as maintenance of ecological balance, making municipal authorities comply with statutory obligations of provision of civic amenities, violation of fundamental rights etc. It has provided an opportunity to citizens, social groups, consumer rights activists etc., easier access to law and introduced a public interest perspective. Justices P.N. Bhagwati and V.R. Krishna Ayer have played a key role in promoting this avenue of approaching the apex court of the country, seeking legal remedies in areas where public interests are at stake. PIL has been considered a boon, as it is an inexpensive legal remedy due to nominal costs involved in filing the litigation. But there are some problems also in the PIL cases. There has been an increase in the number of frivolous cases being filed due to low court fees. Genuine cases got receded to the background and privately motivated interests started gaining predominance in PIL cases. In view of this, the Supreme Court has framed certain guidelines governing the PIL. Presently the court entertains only writ petitions filled by an aggrieved person or public spirited individual or a social action group for enforcement of the constitutional or the legal rights of a person in custody or of a class of persons who due to reasons of poverty, disability, socially or economically disadvantaged position are finding it difficult to approach the court for redress. PIL is an extraordinary remedy available at a cheaper cost. As Justice Bhagwati observed in the case of Asiad workers case, now for the first time the portals of the court are being thrown open to the poor and the downtrodden. The courts must shed their character as upholders of the established order and the status quo. The time has come now when the courts must become the courts for the poor and the struggling masses of this country.
